Horne responds to attorney general's criticism of ESA management

State Superintendent of Public Instruction Tom Horne has responded to comments made by Attorney General Kris Mayes regarding the management of the Empowerment Scholarship Program by the Arizona Department of Education. In a statement released on March 13, 2025, Horne addressed the criticism from Mayes.

Horne said, "When my department found fraud in the ESA program, we sent the case to the Attorney General for prosecution. Mayes is so incompetent that someone who should have been convicted was acquitted."

He further commented on staffing levels within different government offices, saying, "Our department has more than 600 people who do nothing but work on education. The Governor’s office has perhaps 3 or 4 people, but Mayes’ office has zero."

The statement highlights ongoing tensions between state education officials and the Attorney General's office over the handling of cases related to educational programs.
