The Administrative Office of the Courts has implemented an increase in filing fees for 2025, affecting all cases, including divorce and legal separation. However, an exception exists for parties who reach agreements in advance and file jointly. Those using the Summary Consent Decree process in Maricopa County will benefit from a fee reduction of approximately $300.
"The court recognizes that—in some cases—parties who are separating have reached agreements about dividing property and debts, parenting time and legal decision-making, and support," stated Family Court Presiding Judge Ronda Fisk. "These parties want a non-adversarial, cost-effective, efficient way to finalize their divorce or legal separation, with limited court involvement. The Summary Consent Decree Process lets them do that."
This process is designed for situations where both parties have agreed on all matters before filing for divorce or legal separation. They submit a combined petition and response without needing to serve documents. The signed consent decree must be submitted within sixty days of initial filing for court approval.
If compliant with the law, the judge will sign the decree within 81 days of filing. If issues arise, an order will be sent to correct them. Before signing by the judge, parties can withdraw from the agreement jointly by submitting a notice of intent.
A Family Department survey indicates that most participants found the Summary Consent Decree process timely and fair.
"Summary Consent Decree helped to reduce some stress in an already very stressful situation," shared one petitioner regarding their experience during a difficult period involving substance abuse issues.
"Ending a marriage can be a stressful process," said Judge Fisk. "To the extent we can, the court wants to help parties who can reach agreements reduce their paperwork, expenses, and time spent in court." Efforts are underway with the Clerk of Court to further simplify this process by enabling online submissions without courthouse visits.
