Maricopa County sues mulching operation over zoning violations

Maricopa County has initiated a lawsuit against Growers Market, a mulching operation in Laveen, following inspections that indicate non-compliance with an order to cease operations. The Maricopa County Board of Supervisors approved the litigation on December 11, and the lawsuit was filed on December 18.

Residents have expressed concerns about unpleasant odors from the site for several months. Last month, it was discovered that the business lacked a special use permit and was ordered to either shut down or apply for proper entitlement.

“I coach a baseball team on a field two miles from this business and the odor is overwhelming,” said Supervisor Steve Gallardo, District 5. “The County received hundreds of complaints and inspected the property many times. It is time for the business to wrap up and move to a more appropriate area.”

In September, the County notified the property owner of zoning violations, leading to a hearing in November. The hearing officer found Growers Market responsible for operating without proper entitlement and ordered an immediate cease-and-desist with daily fines of $75. The business is required to vacate by March 10, 2025.

Despite these orders, residents reported continued operations at Growers Market after November 5, including new materials being brought onto the property.

“Businesses are welcome near residential areas, but their economic endeavors shouldn’t jeopardize the quality of life of their neighbors,” added Gallardo.

Further inspections prompted action on December 11 by authorizing the County Attorney’s Office to seek an injunction enforcing zoning ordinance compliance. The business lacks a special use permit necessary for its operation in a rural/residential zone.
