Maricopa County Attorney Rachel Mitchell announced on Apr. 6 that Gustavo Gavia Elias has been indicted for allegedly striking and killing a motorcyclist with his SUV.
The case is significant because it involves allegations of intentional harm, impaired driving, and endangerment of minors. The charges stem from an incident on March 18 in Chandler, where authorities say Gavia Elias intentionally hit a motorcycle while driving under the influence, resulting in the rider’s death. Two juveniles were reportedly present in the vehicle at the time.
Investigators allege that there was ongoing animosity between Gavia Elias and the victim prior to the collision. Authorities also claim that Gavia Elias acted aggressively behind the wheel before eventually striking the motorcycle.
Gavia Elias faces several charges: one count of second-degree murder (a class one dangerous felony), two counts of child abuse (a class three felony and a dangerous crime against children), and two counts of aggravated driving while under the influence (a class six felony).
Mitchell emphasized, “A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.”
